USE OF THE PLATFORM

Welcome to radiumcare.com (“Website”) its tools and applications is an online service operated and managed by Radium Care (P) Limited (“Radiumcare” or “we” or “us”). The term “Platforms” refers to the combination of the Website, tools, and applications. You are considered to have accepted the terms and conditions of the agreement stated below, as well as any updates that may be made from time to time, by utilizing Radiumcare’s Platform, services, or products. to time (“User Agreement”/“T&C”), which is, for an indefinite period and you understand and agree that you are bound by such terms till the time you access/use Radiumcare Platforms.

These Terms of Use regulate how you use and behave on our platforms, whether you are accessing them from a computer or a mobile device (for example, through an iOS or Android application). You agree to review these Terms and Conditions as frequently as possible, since we reserve the right to alter, add, remove, or modify any section of them at any time and without giving you any previous notice. Your continued use of the Platforms following such revisions will imply that you accept such revisions to the T&C and agree to adhere to it. For this reason, we encourage you to review these T&C each time you access and place your order. User herein shall mean the persons who browse, access, order products or who avail the services (“Users”).

Whether or not you have read the Policies, just by accessing or using the Platform, you agree to be bound by their terms of use and policies. ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORMS INDICATES YOUR UNCONDITIONAL AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT, SO PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING.

ELIGIBILITY TO USE

Only those who are able to enter into legally binding contracts under the relevant laws may use the Platforms. Users of the Platform are not permitted to be “incompetent to contract” in the sense of the Indian Contract Act, 1872, which includes undischarged insolvents and others. At our sole discretion, we reserve the right to cancel your membership and deny you access to the Platforms. Users who have had their membership suspended or terminated by us for whatever reason won’t be allowed to use the Platforms.

You certify that you are authorized to bind the business entity to this User Agreement if you are registering as one. We make no representation that any products or services referred to in the materials on the Platforms are available outside India. Those who choose to access these Platforms and its tools from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. We deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India. We will only ship the products to states with open import rules, and we disclaim all liability for any orders placed for goods coming from states with import restrictions.

To purchase our products and/or use our services, you must be at least eighteen years old.This include, but is not limited to, using any of our platforms, such as the website, mobile applications, and social media, chatting with one of our professionals, signing up for our newsletters, sharing personal information, and so on.

ACCURACY OF CONTENT AND INVITATION TO OFFER

We have provided correct information and data by using due diligence and care. We have taken reasonable precautions to guarantee that all items have been accurately described and that the prices listed are accurate at the time of publishing while preparing information for the Platforms. This is especially true when it comes to the product prices. All prices are displayed inclusive of all taxes. Packaging of the products may vary from that shown on the Platforms. The weights, dimensions, and capacities given are approximate only. We have made every effort to display as accurately as possible the colors of our products that appear on the Platforms. However, as the actual colors you see will depend on your monitor/phone screen, we cannot guarantee that your monitor’s/phone screen’s display of any color will accurately reflect the color of the product on delivery. We are responsible solely for the content available regarding our products/services on the Platforms as provided by us. If you rely on information from any other platform or platforms, including social media sites, you will not be held responsible for it unless we have confirmed it to you before.

All products/services and information displayed on the Platforms constitute an invitation to offer. Your purchase order is an offer that is subject to the terms and restrictions outlined in this User Agreement. We reserve the right to partially or completely reject your offer. As soon as the requested goods or products are shipped, we shall consider your order accepted. It’s possible that not every goods will be shipped at the same time that you ordered. If such a situation arises, the portion of the order that has already been shipped will be considered accepted by us, and the remaining amount will remain available for acceptance or rejection. Radiumcare will not accept your offer in any way before the product(s) you have ordered are actually dispatched. In the event that you have provided us with your contact information, we will get in touch with you via phone or email as soon as we can to confirm that we have received your order. If necessary, we will also follow up with you to confirm that the order has been dispatched and, consequently, accepted.

GENERAL TERMS OF USE

Users hereby agree to be bound by these General Terms of Use:

User is hereby authorized to use the Platforms for a lawful purpose and for the purposes as mentioned under the policies of Radiumcare. Any violation of the policy will lead to strict legal action against the User in accordance with the terms of the policies and applicable laws.
Radiumcare strives to provide the best prices possible on products and services to Users buying or availing from the Platforms. Prices and availability are subject to change without notice or any consequential liability on Radiumcare.
The prices and offers displayed for each item under a promotion will be for limited stocks in selected categories and the respective days of the promotion only.
Radiumcare may at its sole discretion modify, extend, update or withdraw the offers on products without prior notice to the Users. In such events, the revisions, as the case may be, will be updated on the Platforms accordingly.
In case of Cashback offers extended by banks during the aforesaid promotion period, the User will, in addition to these Terms of Use, be governed by the terms and conditions of the said bank/card issuer.
Radiumcare shall have the right to modify the price of a product or service any time, without any prior information.
Cancellation by Radiumcare: there may be certain orders that Radiumcare is unable to accept and must cancel. Radiumcare reserves the right, at its sole discretion, to refuse or cancel any order for any reason whatsoever, without assigning any reason to the User. The User accepts and undertakes that the same is acceptable and he/she/it will not contest/raise any dispute against Radiumcare on the same. The situations that may result in cancellation of the User’s order include, without limitation, non-availability of the product(s) or quantities ordered by the User, non-availability of the services, inaccuracies or errors in pricing information, or problems identified by Radiumcare.
Radiumcare may also require additional verification or information before accepting any order. Radiumcare will contact the User if all or any portion of the User’s order is canceled or if additional information is required to accept the User’s order. If the order is canceled after the credit/debit cards, Net banking, wallets, UPI/ any other mode of payment has been charged, the said amount will be reversed in the User’s credit/debit card account and Radiumcare shall not be liable for such cancellation.

DELIVERY

From the date of order placing, delivery usually takes between 5–7 business days. The order details page will provide the expected shipping and delivery times at the time of order placement. Since the projected delivery times are only estimates, there can be some unexpected delays that are out of our control. Delivery may be split up into many shipments for orders with multiple products.

You agree that Radiumcare shall not be liable to pay for any damage or loss, either direct or indirect, owing to such cancellation of the order or delay in delivery. It is understood by the User that Radiumcare uses third-party delivery services and shall not be liable to pay for any damages caused by the actions, negligence, or delay by the delivery agent.

QUANTITY RESTRICTIONS

We reserve the right to impose a limit on the quantity of products purchased by a single individual, household, or order, at our sole discretion. The same credit/debit card, the same account, and orders using the same billing and/or delivery address may all be subject to these limitations. Should such limitations be implemented, we will notify the client. Additionally, we retain the right, in our sole discretion, to forbid sales to anybody.

Users are prohibited from reselling any products of Radiumcare in an unauthorized manner, either on any online platform or in-person. Any such act on the part of any User shall give Radiumcare the unfettered right to terminate their Account in addition to initiating legal action, both civil and criminal, available at law or in equity.

PRODUCT AND PRICING INFORMATION

Although we make every effort to present correct product and pricing information, typographical or pricing errors could happen. We reserve the right, at our sole discretion, to reject or cancel any orders placed for any product that is listed at an incorrect price or with inaccurate information due to a pricing or product information error, unless the item has already been shipped. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted, and we will have the right to modify the price of the product and contact you for further instructions using the email address or the contact number provided by you during the time of registration, or cancel the order and notify you of such cancellation. If you place an order with us online, your credit or debit card, UPI, wallet, net banking, or other payment method may be charged. You will be notified by phone or email after the payment has been successfully made.The payment may be processed prior to dispatch of the product that you have ordered. Before using a coupon code, promotional offer, or discount, it is your duty as the user to make sure it is applicable.

USE OF THE PLATFORMS

Your Account

For registering a new User on the Platforms, Radiumcare may collect certain personally identifiable information, including your first name and last name, and contact details such as your email address, phone number, billing/shipping address, and other contact information, demographic details, and so on. By registering on the Platforms, it is deemed that the User has expressly consented for such data collection and processing for their use of the Platforms. A single user account (also known as a “Account”) may be created and maintained. You agree to take responsibility for all activities that happen under your account, and you will be in charge of keeping your password and account private as well as limiting access to your computer. You acknowledge that the information you provide or publish on the Platforms, in any manner whatsoever, including feedback, comments, and reviews, is not confidential or proprietary and does not infringe any rights of a third party in any manner whatsoever. Each Account is non-transferable and may not be sold, traded, combined, or otherwise shared with any other person.

CUSTOMER SOLICITATION

By accessing the Platforms or placing an order or sending any information, you are communicating with Radiumcare electronically, and you agree to receive communications (including transaction, promotional, and/or commercial messages) from Radiumcare periodically and as and when required. We may communicate with you by email, SMS, phone call, or by posting notices on the Platforms or by any other mode of communication.

INTELLECTUAL PROPERTY RIGHTS

We and our suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content, and other materials, which appear on this Platform.

No license under any of our or any third party’s intellectual property rights is granted, and access to this platform does not and will not be deemed to provide any license. We hold all rights to this Platform, including copyright, or we have a permission to use them. You may not modify, distribute or re-post anything on this Platform for any purpose.

Radiumcare’s names and logos and all related product and service names, design marks, and slogans are the trademarks or service marks of Radiumcare or licensed to Radiumcare. All other marks are the property of their respective companies, and you shall not use or exploit the same in any manner whatsoever. No trademark or service mark license is granted to you in connection with the materials contained on this Platform.

Access to this Platform does not authorize anyone to use any name, logo, or mark which appears on the Platform in any manner. All references to third-party names, marks, products, or services on this Platform, as well as hypertext links to third-party Platforms or information, are made purely for your convenience and do not in any way imply our endorsement, sponsorship, or recommendation of the third party, information, product, or service.

All materials, including images, text, illustrations, designs, icons, photographs, programs, music clips or downloads, video clips, and written and other materials that are part of this Platform (collectively, the Content) are intended solely for personal, non-commercial use. The act of downloading or copying software does not grant you any ownership, rights, or interests in the contents or software you have downloaded. Except as mentioned above, you are not permitted to copy, publish, transmit, distribute, show off, alter, or make derivative works from any of the Content, the Platform, or any connected software, or to engage in any kind of complete or partial commercial endeavor involving any of these materials.

The compilation (meaning the collection, arrangement, and assembly) of all Content on this Platform is the exclusive property of Radiumcare and is also protected by Indian and international copyright laws. This Platform’s software and Content may only be used as a resource for shopping. It is expressly forbidden to use the Content on this Platform for any other purpose, including reproduction, modification, distribution, transmission, republication, display, or performance.

OWNERSHIP OF RIGHTS

Without Radiumcare’s prior written consent, you are not permitted to use this Platform or its contents for any purpose other than your own personal, non-commercial use. This includes copying, sharing, storing, and duplicating them in whole or in part. All data that is shown, sent, or stored on the Platform is protected from infringement and other legal restrictions on intellectual property. Copyrights and other intellectual property in respect of some of the content on the Platform may be owned by third parties. This site is designed, updated, and maintained by Radiumcare or its licensors. The content on the Platform may not be altered, published, transmitted, transferred, sold, reproduced, or used in any other manner for commercial gain. You may also not distribute, re-post, perform, exhibit, or make derivative works from any of the content.

USAGE RESTRICTIONS

You shall not use the Platform for any of the following purposes:

spreading any content that is illegal, intimidating, defamatory, threatening, grossly harmful, vulgar, obscene, blasphemous, defamatory, pornographic, paedophilic, invading someone’s privacy, hateful, or offensive to certain races or ethnic groups, disparaging, or that in any way relates to or encourages money laundering or gambling;
sending content that incites behavior that is illegal, exposes one to civil liability, or violates any other applicable laws, rules, or standards of conduct;
gaining access to other computer networks without authorization;
Interfering with any other person’s use or enjoyment or disrupting networks of the Platform;
copyright-protected work being created, distributed, or stored electronically without the owner’s permission;
It is not allowed for you to host, display, upload, alter, publish, transmit, update, or share any information on the Platform that is the property of someone else and that you are not authorized to access;
violates any copyright, patent, trademark, or other intellectual property rights;
deceives or misleads the recipient regarding the source of these messages or sends any content that is blatantly insulting or ominous;
Impersonate another person or harms minors in any way;
Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource, including the Platform; and
\threatens India’s unity, integrity, defense, security, or sovereignty; jeopardizes friendly relations with other countries; disrupts public order; incites the commission of any crime that can be prosecuted; obstructs an investigation into any crime; or is offensive to any other country.

You are also prohibited from:

harming the Platform’s security or integrity, or attempting to do so;
Transmitting any information (including job posts, messages, and hyperlinks) on or through the Platform that is disruptive or competitive to the products/services provided by us;
Intentionally submitting on the Platform any incomplete, false, or inaccurate information;
contacting other Platform users with any unwanted messages;
using the Platform to navigate or search using any engine, program, tool, agent, or other mechanism (including robots, spiders, avatars, or intelligent agents);
Attempting to decipher, decompile, disassemble, or reverse engineer any part of the Platform;
Copying or duplicating in any manner any of the content on the Platform or other information available from the Platform; and
Any material on the Platform may not be framed, hotlinked, or deeplinked.

DISCLAIMERS AND LIMITATION OF LIABILITY

All content, products, and services on the Platform, or obtained from a website to which the Platform is linked (a “linked site”) are provided to you “as is” without any guarantees or warranty. Radiumcare disclaims all express and implied warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security, and accuracy, with regard to any content, goods, or services on this Platform.

INDEMNITY

You agree to defend and hold harmless Radiumcare (and its officers, directors, agents, subsidiaries, joint ventures, and employees) against any claim or demand, including reasonable attorneys’ fees, resulting from your violation of any law or third party’s rights, your breach of these Terms of Use, or any combination of these.

TERMINATION

These Terms of Use are effective unless and until terminated by either you or Radiumcare. You may terminate these Terms of Use at any time, provided that you discontinue any further use of the Platform. Radiumcare may terminate these Terms of Use at any time and may do so immediately without notice, and accordingly, deny you access to the Platform, Such termination will be without any liability to Radiumcare. All contents downloaded or otherwise received from this Platform, including with all copies of such materials, whether created under the Terms of Use or otherwise, must be promptly destroyed upon any termination of the Terms of Use by either you or Radiumcare. Radiumcare’s right to any comments shall survive any termination of these Terms of Use. Any such termination of the Terms of Use will not impact any responsibility that may have arisen under the Terms of Use, nor will it absolve you of your need to pay for the goods that you have already bought from the Platform.

GOVERNING LAW

The Terms of Use shall be construed in accordance with the applicable laws of India. The Courts at New shall have exclusive jurisdiction in any proceedings arising out of these Terms of Use.

MISCELLANEOUS PROVISIONS

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Radiumcare as a result of these Terms of Use or any use of the Platform. Radiumcare’s performance of these Terms of Use is subject to existing laws and legal process, and nothing contained in these Terms of Use is in derogation of Radiumcare’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Platform or information provided to or gathered by Radiumcare with respect to such use.

The remaining terms of use will remain in effect in the event that any part of these terms is found to be invalid or unenforceable under applicable law, including but not limited to the liability limitations and warranty disclaimers stated above. In such a case, the invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that most closely matches the original provision’s intent.

These Terms of Use constitute the entire agreement between you and Radiumcare with respect to the use of the Platform and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Radiumcare with respect to the use of the Platform. In legal or administrative proceedings based on or relating to these Terms of Use, a printed copy of these Terms of Use and any electronic notice will be admissible to the same extent and under the same restrictions as other business documents and records originally generated and maintained in printed form.
